For federal tax purposes, the IRS generally classifies a non-U.S. citizen as either a Resident Alien (RA) or a Nonresident Alien (NRA) based primarily on the Green Card Test and the Substantial Presence Test.

This distinction matters because RA and NRA taxpayers generally follow different tax rules and may need to file different tax returns.

What Is a Resident Alien (RA)?

You are generally considered a Resident Alien for U.S. tax purposes if you meet either of these two tests during the calendar year:

1. Green Card Test

You generally meet the Green Card Test if you are a lawful permanent resident of the United States at any time during the calendar year. Substantial Presence Test

If you do not have a Green Card, you may still become a Resident Alien based on how many days you are physically present in the United States.

You generally meet the Substantial Presence Test if you were physically present in the U.S. for:

At least 31 days during the current year, and

At least 183 weighted days during the current year and previous two years combined.

The IRS calculates the 183-day total using:

Current-year days + 1/3 of previous-year days + 1/6 of second-previous-year days

For example, if you were present in the United States for 150 days in 2026, 120 days in 2025, and 60 days in 2024, the calculation would be:

150 + (120 × 1/3) + (60 × 1/6) = 200 days

Assuming no exclusions or exceptions apply, you would meet the 183-day requirement of the Substantial Presence Test.

What Is a Nonresident Alien (NRA)?

If you are not a U.S. citizen and do not meet either the Green Card Test or the Substantial Presence Test, you are generally classified as a Nonresident Alien for U.S. federal tax purposes.

This distinction affects more than the tax form you file. Resident aliens are generally taxed in a manner similar to U.S. citizens, including U.S. taxation of worldwide income, while nonresident aliens are generally subject to U.S. tax rules applicable to certain U.S.-source income and income effectively connected with a U.S. trade or business.

In general:

Tax Status

Common Federal Income Tax Return

General Tax Treatment

Resident Alien (RA)

Form 1040

Generally reports worldwide income

Nonresident Alien (NRA)

Form 1040-NR

Generally subject to U.S. tax on applicable U.S.-source income

The actual filing requirement depends on your income and individual circumstances.

Are F-1 and J-1 Students Automatically Nonresident Aliens?

Not always.

This is one of the most common areas of confusion for international students.

Students temporarily present in the United States under F, J, M, or Q visas may qualify as “exempt individuals” for purposes of the Substantial Presence Test. Importantly, “exempt individual” does not mean exempt from U.S. taxes. It means that certain days of physical presence in the United States are not counted when applying the Substantial Presence Test.

For example, an F-1 student generally does not count days of presence as a student toward the Substantial Presence Test during the first five calendar years in which the student qualifies for the exemption. After that period, the student may begin counting days and could become a Resident Alien if the Substantial Presence Test is met.

Therefore, simply saying “I have an F-1 visa, so I am an NRA” is not enough to determine tax residency. You need to consider when you entered the United States, your visa/status history, the number of days present, and whether an exception applies.

Students who exclude days under these rules generally need to file Form 8843.

Can You Meet the Substantial Presence Test and Still Be an NRA?

In certain circumstances, yes.

For example, the IRS provides a Closer Connection Exception. A person who meets the Substantial Presence Test may still qualify to be treated as a nonresident if specific requirements are satisfied, including generally being present in the United States for fewer than 183 days during the current year, maintaining a tax home in a foreign country, and having a closer connection to that foreign country than to the United States. Additional requirements apply.

Tax treaties can also affect residency determinations in some situations. In addition, a person can be a resident for part of a year and a nonresident for another part, resulting in dual-status alien treatment.

How Can I Quickly Determine My U.S. Tax Residency?

A useful starting point is:

Do you have U.S. lawful permanent resident status?
If yes, check the Green Card Test.

No Green Card?
Calculate your days under the Substantial Presence Test.

F, J, M, or Q status?
Check whether some of your U.S. presence days qualify to be excluded.

Meet the Substantial Presence Test but maintain strong tax ties outside the U.S.?
Check whether the Closer Connection Exception or an applicable tax treaty could change the result.

For complicated situations—especially changes in immigration status, long-term F-1/J-1 presence, dual-status years, or treaty claims—the result should be determined based on your actual dates and circumstances rather than visa type alone.

What Is the Main Difference Between RA and NRA?

The simplest way to remember it is:

RA and NRA are U.S. tax classifications, not immigration classifications.

Having a temporary visa does not automatically make you an NRA, and spending a certain number of days in the United States does not always make you an RA because some days may be excluded from the Substantial Presence Test.

If you are classified as an RA, you will generally file Form 1040 and report worldwide income under U.S. federal income tax rules. If you are an NRA with a filing requirement, you will generally file Form 1040-NR, with different rules governing taxable income, deductions, credits, and treaty benefits.

For international taxpayers, correctly determining Resident Alien vs. Nonresident Alien status should come before choosing which U.S. tax return to file.

Official IRS Resources

IRS – Determining an Individual’s Tax Residency Status

IRS – Substantial Presence Test

IRS – Publication 519: U.S. Tax Guide for Aliens

Disclaimer: This content is for general informational purposes only and does not constitute tax or legal advice.
